Small Business Majority files Amicus Brief underscoring the FTC’s authority to enforce their ban on non-compete agreements

On November 12, Small Business Majority and Evan Starr, economist and Associate Professor of Management and Organization at the University of Maryland’s Robert M. Smith School of Business, filed an Amicus Brief in the United States Court of Appeals for the Eleventh Circuit which underscores the FTC’s authority to enforce their final rule to restrict the use of non-compete agreements, which encourages entrepreneurship, small business growth, and workforce development on Main Street. Small Business Majority research has found that nearly half (46%) of small businesses were subject to a non-compete agreement that prevented them from starting or expanding their business and nearly 6 in 10 small business owners supported the FTC’s 2023 proposed rule to ban non-compete agreements.
