Supreme Court EMTALA Opinion Will Help Ensure Women Entrepreneurs in Idaho Have Access to Essential Care for Now, But More is Needed

Statement from Rachel Shanklin, National Women’s Entrepreneurship Director for Small Business Majority, on the high court’s decision not to allow Idaho's abortion ban to supersede the Emergency Medical Treatment and Labor Act at this time

“The U.S. Supreme Court’s decision to temporarily stop Idaho’s attempt to block pregnant people from accessing critical maternal care underscores the need for small businesses to have more certainty around access to emergency care. As we noted in an amicus brief filed along with our allies, it’s likely that the Supreme Court prevented the immediate growth and spread of maternal care deserts in Idaho, which could have the impact of driving away small businesses and their employees. However, this matter has not been settled for the millions who reside in states that have refused to guarantee access to emergency abortion care. We know today’s decision is not the final word on healthcare issues related to abortion, and we hope that in future decisions the Supreme Court protects abortion access so that women have the freedom to decide if and when to have children, a choice that we know plays a significant role in career decisions like taking the leap to start a small business.”
